Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the PuffPoint online ordering, store-owned delivery, and point-of-sale platform, including our customer ordering experience (web and in-store), the store staff console, and the PuffPoint Driver mobile app (collectively, the “Service”). By creating an account, placing an order, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

The Service is used to order age-restricted products, including vape, tobacco, and liquor products. You must be at least 21 years of age (or the minimum legal purchasing age in your jurisdiction, if higher) and legally permitted to purchase such products to create an account or place an order. By using the Service you represent that you meet these requirements. We verify age at checkout and again at delivery, and we may refuse or cancel any order where age or identity cannot be confirmed.

You are responsible for the information you provide and for all activity under your account. Keep your credentials confidential, use accurate and current details, and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms, provide false information, or are used for unlawful purposes.

Products, pricing, availability, taxes, and fees are set by the store you order from and may change. Placing an order is an offer to purchase; the store may accept, decline, or cancel it (for example, if an item is out of stock or age cannot be verified). Payment is processed by Stripe; card details are entered directly with Stripe and are never stored on PuffPoint’s servers. You authorize the applicable charges, including product price, taxes, delivery, and any disclosed fees.

Delivery is fulfilled by the store or its authorized drivers within available areas. For age-restricted orders, the recipient must be the adult who placed the order or another eligible adult, must be present, and must present a valid government-issued ID for verification at the point of handoff. Deliveries will not be left unattended. If age or identity cannot be verified, if the recipient appears intoxicated, or if no eligible adult is available, the order may be refused or returned and applicable fees may still apply. You agree to provide accurate delivery details and to be available to receive the order.

• Purchasing on behalf of, or reselling to, anyone under legal age.
• Providing false identity, age, or payment information, or using another person’s account or ID.
• Using the Service for any unlawful purpose or in violation of applicable tobacco, vapor, alcohol, or other regulations.
• Interfering with, disrupting, reverse-engineering, or attempting to gain unauthorized access to the Service.
• Reselling or commercially exploiting the Service without permission.

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. PuffPoint is a technology platform connecting you with licensed stores; the stores are the sellers of record for their products. To the maximum extent permitted by law, PuffPoint and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, and our total liability for any claim relating to the Service will not exceed the amount you paid for the order giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

We may update these Terms from time to time. Material changes will be posted here with a new effective date, and your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
